2. Our Services

Black Arches Pest Control provides residential and commercial pest control services across the Wasatch Front and Wasatch Back. Specific services, scope, and scheduling are described in your quote or service agreement. We may modify or discontinue services at our discretion.

3. Scheduling & Cancellation

Service appointments are scheduled based on availability. We make every effort to arrive within the scheduled time window.

• Cancellations should be made at least 24 hours in advance when possible
• Missed appointments without notice may be subject to a service call fee
• Emergency services are available and may be subject to after-hours rates

4. Warranties & Guarantees

We stand behind our work with applicable warranties on labor and parts. Warranty terms and duration vary by service type and will be provided at the time of service. Warranties do not cover damage caused by misuse, neglect, or third-party modifications.

5. Estimates & Quotes Are Non-Binding

Any pricing, estimate, or quote — whether provided online, by phone, by text, or in person — is for informational purposes and is not binding until confirmed in a written or signed service agreement. Actual pricing may vary based on property conditions, pest pressure, and the scope of work performed.

6. AI & Automated Content Disclaimer

Portions of this website's content, and any chat, estimator, or recommendation features, may be generated or assisted by artificial intelligence. AI-assisted output may be incomplete, illustrative, or inaccurate, is provided for general informational purposes only, and does not constitute professional, legal, or pest-management advice. 7. No Professional Advice

EXCEPT FOR ANY WRITTEN SERVICE WARRANTY WE EXPRESSLY PROVIDE, THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the website will be uninterrupted or error-free, or that any specific pest outcome is guaranteed beyond the terms of a written service warranty.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACK ARCHES PEST CONTROL LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE WEBSITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING IT. Some jurisdictions do not allow certain limitations, so some may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Black Arches Pest Control from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the website or services or your violation of these Terms.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Subject to the arbitration provision below, the exclusive venue for any dispute is the state and federal courts located in Wasatch County, Utah.

16. Binding Arbitration & Class-Action Waiver

Any dispute arising out of or relating to these Terms or our services will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in Utah, rather than in court, except that either party may bring an individual claim in small-claims court. YOU AND BLACK ARCHES PEST CONTROL WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

30-day opt-out: You may opt out of this arbitration provision by emailing info@blackarchespest.com within 30 days of first accepting these Terms, stating your name and intent to opt out. Opting out will not affect any other part of these Terms.

17. Dispute Notice Procedure

Before initiating arbitration, you agree to first contact us in writing and allow 30 days to resolve the dispute informally. Most concerns can be resolved with a quick call.

18. Pricing, Billing & Payment

Fees are described in your quote or service agreement and are due at the time of service unless otherwise agreed. Recurring (no-contract) plans may be cancelled at any time; cancellation stops future visits and billing. We accept major credit and debit cards. Black Arches Pest Control does not currently offer financing.

19. Termination

We may suspend or terminate your access to the website or services for any violation of these Terms. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and arbitration) will survive.

20. Severability & Entire Agreement

If any provision is found unenforceable, the rest remain in effect. These Terms, together with our Privacy Policy and any signed service agreement, constitute the entire agreement between you and Black Arches Pest Control.

21. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest version, and continued use after changes constitutes acceptance.

US State Privacy Rights

If you are a California resident, you have rights under the CCPA/CPRA regarding your personal information, including the right to opt out of the sale or sharing of personal information, and residents of other US states may have similar rights under their state privacy laws.
